恣意執行死刑的計畫必須立刻終止

緬甸軍方當局近期在極為不公的審判程序之後，准許4人的死刑執行；簽署本聯合聲明的各組織嚴正關切緬甸軍方這樣的行為。我們呼籲緬甸軍方當局，立即停止執行死刑的計畫——這違反國際人權法和國際習慣法禁止恣意剝奪生命的規定；我們並呼籲當局，在超過30年未執行死刑後，正式暫停執行死刑，以及結束自2021年2月以來席捲全國的鎮壓行動。

6月3日，緬甸軍方發言人紹敏通（Zaw Min Tun）宣布，國家管理委員會已經批准4人的定罪和死刑，讓死刑可能在短短幾週內就執行。翁山蘇姬（Aung San Suu Kyi）的全國民主聯盟前成員漂澤亞桑（Phyo Zeya Thaw）和著名民主社運人士覺敏友（Kyaw Min Yu，也稱Ko Jimmy），因《反恐怖主義法》中關於爆裂物、轟炸和資助恐怖主義等相關罪行，在2022年1月被軍事法庭定罪並判處死刑。然而，簽署聯合聲明的各組織認為這些指控具有政治動機。另外2人謀殺1名女子的死刑判決也確定了，死者被認為是軍方在仰光萊達雅鎮的線人。
 
這些人的訴訟在軍方控制的法庭上在極不公平及秘密的情況下審判。在頒布第3/2021號戒嚴令之後，軍方將審理平民案件的管轄權從一般法院轉移至特別或現有的軍事法庭。這些法庭進行簡易程序且無權上訴的審判，法庭審判的多種罪行包含可判處死刑的罪行。

公平審判權的關鍵要素記載於《公民與政治權利國際公約》第14條，屬於基本權利，也是《世界人權宣言》宣布普遍適用的保障之一。作為國際習慣法的一部分，對所有國家來說都具有法律約束力。根據國際法和國際標準，在不公平審判後執行死刑違反了禁止恣意剝奪生命、絕對禁止酷刑及其他殘酷、不人道或有辱人格懲罰的規定。

自2021年2月起，緬甸記錄到令人擔憂的死刑判決上升趨勢，軍方將死刑用作持續大規模迫害、恐嚇、騷擾和暴力傷害人民的工具，包含示威者和記者。根據援助政治犯協會（Assistance Association for Political Prisoners）的紀錄，自2021年2月以來當局至少判處114件死刑。除了其中1件是由軍事法庭轉介的少年法庭判處，其餘全數由軍事法庭審判。報告指出至少有41名被告在審判和定罪時不在場，有些被判死刑的人犯罪當下未滿18歲或患有嚴重社會心理疾病，違反國際人權法和國際習慣法規定的禁令。可取得的資訊指出審判採用簡易程序，且被告無法獲得律師協助。

軍方當局正在採取行動來執行自1980年代末期以來緬甸首次已知的死刑，此舉令人極為擔憂。在超過30年未執行死刑後恢復執行死刑，將成為該國死刑和人權紀錄的明顯退步，且違反《公民與政治權利國際公約》第6條第6款訂定廢除死刑的目標。數十年來，聯合國系統致力於限制死刑的使用，同時不斷呼籲聯合國會員國將死刑從國家法律中移除。除了其他措施之外，自2007年來，聯合國大會在跨區支持增加之下已經通過8項決議，呼籲「以廢除死刑為目的暫停執行死刑」。至今，包含緬甸在內共有144國屬於在法律或實務上廢除死刑的國家，且在國家法律上廢除死刑的國家持續增加——2022年，哈薩克和巴布亞紐幾內亞完全廢除死刑。

我們無條件反對死刑，並要求緬甸軍方當局履行推動和保障人權的國際義務，包含在所有情況下保障生命權，同時立即釋放所有因行使表達自由、結社自由與和平集會自由等權利而受到拘留的人。
